Once you use your 485 related EAD , then you can switch back to H1-B . If this switch is less than an year, then there is a possibilty you might, but definitely after an year, you will need to apply for fresh H-1 subject to quota and all.
If you are primary applicant, then my advise would be to use H1-B if you can.

this makes it very hard for people who jumped jobs in their 7th/8th years with 1 year extensions from new employer. All were hoping to get LC+I_140 done within that year so they are eligible for further H1B extensions.

Hi Antonio, I have the 70-210 AF (non-D). It's from the first generation of Nikkor AF lenses. I've also got the 18-70. The focus on the 70-210 is pretty sluggish. It can't keep up to fast moving targets, at least w/ the D80 (I've heard the D200 has a better focus motor -- this lens uses the old in-camera focus motor rather than the newer/quieter in-lens focus mechanism). I've shot some sports with this lens, and it's fine when you can pre-focus on a spot, or when the action is moving perpendicular to you (rather than towards/away) -- it can keep up. If you can live with these limitations, then the lens will work for you. I can't really comment on how the 70-210 AF-D works, though I've read the same thing, that it's geared for faster focus.

While travelling on H4, IF she gets her H1 Approval she can get the same stamped in the overseas and travel whenever even after oct 1, No issue with that.
Now on the other hand if she travels back on H4 after oct 1 which is the start date of H1 that may override the H1(Not sure consult appropriate attorney)

Could you please pm us the IP address of your machine. It will help us to diagnose the problem and/or let you know the reason. Its possible that your work environment is using NATing. So all machines from within that network will propagate the same external IP address. If you could send us your IP address at work, we will be able to diagnose the problem.

Hello!
My H1B got expired in Sep 2010, ( applied for transfer before expiry), got RFE and finally approval last week, but 797 form has the validity from current date(approved date) instead of requested date in Sep 2010. So now is the period from sep 2010 to 797 approved date is considered as out of status or how it is? I have paystubs during this time and on job all the time. Any implications while going for h1b stamping in India and or at port of entry and in future GC.
Any inputs are apprciated. Thanks!
If I remember correctly, you are allowed to work for 240 days from the receipt date while your case is pending. If the approval does not come within 240 days, you have to stop working and wait for the approval. You are NOT considered out-of-status as long as your petition was filed before the current H1 expired.

sounds like you have already sent a response to the RFE and you want to follow on... yes... go ahead and do it... its not like they are waiting for you to make a mistake and then they will close your file.. for the most part, USCIS is a friend... so dont worry and send in your follow on document asap. make sure you dont repeat your earlier documents. just send in the new one and refer to your earlier RFE response clearly saying that an additional document has now become available...

For the marriage proof, i attached the marriage certificate which has my incorrect date of birth. I attached the affidavit describing that there is the entry error in the marriage certificate and applied for the correction and as in process with "Registrar of Marriage" office in India. In the meantime, i received the corrected marriage certificate today with the scanned copy. My question is, Can i send my corrected marriage certificate document today to USCIS ? Will they accept with one day delay?

Hi GURU's,
I received my original I 485 receipt on which my receipt date is - July 10 2007 and Notice Date is - Sep 12 2007 from CSC(even though I applied to NSC)
After one week I have received Transfer Notice from CSC on which receipt date is - Sep 12 2007 and Notice Date is- Sep 17 2007 saying that my case is transferred to NSC
Now I am confused,

Entered US---oct--2008 on h4
Filed for h1---april 2009
H1 approved---aug 2009
Actually i had to start a project dated 12-oct'09 but unfortunately the project got cancelled.From then i have been looking for project but no luck.Currently i am in a dilemma regarding my status and course of action.I am thinking to change my status to H4 again by filing i-539.
The main problem is my employer did not run any payroll for me since oct-st(official kick off date afetr h1 COS approval) i did not have any project and when i ask him about that he says he can state that i will officially join the company in Jan 2010 and he will start running the payroll from jan 2010(irrespective of me getting a project and he says i have to pay half of my taxes from my pocket that the employer would be entitled to pay and he will pay the rest and cut it from my payroll once i get a project).I am totally in a state of confusion and do not want to take any risk anymore regarding my status and from the employer(he is taking advantage of my situation).
My questions are
1. How safe is it to apply COS at this point
2. If in case he starts running my payroll from Jan and still i dont land in a project even after couple of months can i go head and change my status to h4 in march with the 2 paystubs (jan and feb which he is promising to run)
3.in worst case if the payroll is not run by him what would be the best course of action
I would appreciate your response

This item deals with "Wage per week " in this field after i checked out my application lawyer gave the whole years income instead of weeks income. as i enquired he said even though "/year" is ideal to mention immigration officers know that this amount is same as that of Labor and thats not an issue . any comments please?
