I have 2 H1B Transfer questions for clarification.
1. Can H1B Transfer be filed when H1B Extension is pending with the current employer?
Yes, a transfer could be filed while an extension is pending. This is the so-called anchor transfer. However, the transfer would be denied if the extension petition is withdrawn before the transfer is approved.
2. Do i need to have copy of I-140 approval notice for H1B Tranfer? The current employer does not share this document.
The 140 approval notice is not required unless this is a post six year transfer/extension.

Hi ,
I am in strange situation. I am in 7th year of H1B and I have applied for H1B extension which was expiring on April 4th through my company on Feb 14th through normal processing. I have the LIN number from receipt notice. I was never able to check the status online as the LIN number was not found and when attorney called USCIS regarding this on March 23rd, We were told that the information will be updated to see the status online. Our attorney did not follow up with USCIS since then. Our attorney followed up again just today and found that an RFE was sent on March 25th which was never received by attorney. Currently we do not know what exactly is requested in the RFE or dead line for the response. RFE was requested again today from USCIS and was told that will be received in around 30 days. Do you think new dead line will be given for the RFE as the initial deadline might have passed for the initial RFE. I am not sure what to do at this point if I am in status or not. Please provide your advise as to what I should be doing? Appreciate your advises.

Hello everybody,
First of all I must appologize because I mentioned this in the forum before but that was a different question that I asked.
My wife's Labor lists a 4 year degree with a BS in Mechanical Engineering as a requirement.
We filed I-140 with her old H1B evaluation which says she has a 4 year degree in Civil Engineering (stupid me :mad: ).
I found another evaluator who looked closely and gave us an evaluation for BS in Mechanical Engineering because her degree is way closer to the Mechanical than it is to the Civil Eng.
Will USCIS reject this I-140 on the spot based on the fact that she doesn't meet the requirements or issue an RFE ? If they issue an RFE and we send the Mechanical Eng. evaluation, will the fact that we filed first with the Civil Eng evaluation cause any problems ? Are we assuming the worst and is not such a big deal ??
She worked on H1B for 7 years as a Mech Eng and this is NOT a labour substitution.

as long as your gc is pending, you can get 1 year extension. After 140 approval and 485 still pending you can get 3 year extension. OR you can apply for EAD to continue in status.

I am in similar situation. If she comes here and we get married "new" and I am GC Holder can she get a GC too ( provided PD is current ) OR I have to wait till I become Citizen and then file ....

I recently applied for a PAN Card. Got a DD through my parents in India and sent the form. Today they sent a mail with following --
1) We are yet to receive payment for application.- Kindly e-mail Cheque /DD no. and date on which amount has been debited from your account
2) Photograph provided is not proper for scanning.
Have any one faced similar problem ? A valid DD was included and they say they did not receive the payment ?? Also, the photo was of right size and clear enough so I am not sure what else to do.
Any help will be greatly appreciated
check with your bank whether they cashed the DD. tell them DD is lost - they might cancel old one & issue new one.

We did the exact same thing. We informed officer that my wife's Extension is pending, he said that's fine and gave her I-94 valid for 40 days (time remaining on her H4 visa).

In 2005 I (american citizen) applied for a I-130 petition for my husband who is an Indian citizen. (It was approved.) Then after that the case was placed under administrative review at the Mumbai embassy in India. It is still pending for over four years now. As of Sept. 2008 My husband recieved a letter stating the petition was sent to the USCIS here for review and possible revocation. We were told to contact them here for our case. They can not find anything on our case.
He is now in Canada on a student visa. Can I apply for a K-3 visa while he is in canada on a student visa? I was told he would need to go back to India for me to apply for a K-3 visa. USCIS agent told me to take the steps in applying for a K-3 visa for him.

My spouse was on H4 and then got EAD (based on dependent 485 status).Now my spouse employer is willing to apply for H1 b, I just want to see if it is possible to apply for H1b when the current status is AOS
